1. Agreement to Terms
By accessing or using our website located at **dmtocal.com** ("Service"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, please do not access or use our services.
2. Description of Service
DMtoCal provides an online clipboard-to-calendar parsing tool. It allows solo artisans and merchants to extract booking information from client messages into standard calendar (.ics) files and generate confirmation messages. We reserve the right to modify, suspend, or discontinue the service at any time.
3. Client Data & Privacy Consent
By inputting third-party client conversation logs, names, or contact details into the Service, **you (the Merchant) represent and warrant that you have obtained the necessary consent from your client** to process their data, or that you possess another valid lawful basis for such processing under applicable data protection laws (such as GDPR, CCPA, or PIPEDA). DMtoCal acts strictly as a transient data processor and does not store or retain your raw client chat logs.
4. User Accounts & Quotas
- **Free Tier**: Restricted to 3 total parses for guest users. Registered email users receive 5 free parses per month. - **Pro Tier**: Paid subscriptions unlock unlimited parsing quotas, custom confirmation styles, and priority speeds. - You agree to use the service fairly and prevent automated bots from abusing your account tokens.
5. Fees, Subscriptions & Payments
Subscribing to our Pro Plan incurs a monthly recurring fee of **$14.90**. Payments are billed in advance on a recurring monthly cycle. All billing transactions, invoicing, local digital tax calculations (such as VAT or Sales Tax), and refund disputes are processed on our behalf by our payment partners (including **Lemon Squeezy** or **PayPal**).
6. Disclaimer of Warranties (AI Accuracy)
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DO NOT WARRANT THAT THE AI-EXTRACTED APPOINTMENT TIMES, NAMES, OR DETAILS WILL ALWAYS BE 100% ACCURATE. NATURAL LANGUAGE PROCESSING IS SUBJECT TO AI ERROR. **YOU ARE SOLELY RESPONSIBLE FOR VERIFYING APPOINTMENT ACCURACY BEFORE SAVING FILES TO YOUR CALENDAR OR SENDING CONFIRMATIONS TO CLIENTS.**
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DMTOCAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF BUSINESS, REVENUE, PROFIT, CLIENTS, OR REPUTATION ARISING FROM APPOINTMENT ERRORS, DOUBLE BOOKINGS, SYSTEM DOWNTIME, OR MISSED CALENDAR NOTIFICATIONS.
